Some great tips, thanks! It appears Danoc1 FXAA Injector makes the game unplayable in Windows 8.1 x64. A quick Google search and I found something to do with with Windows 8/8.1 having some issues with FXAA.

If you get the DX error it appears to be related to the gpu overheating. I have had the issue as well but once I made sure I was getting better cooling the DX errors went away and I haven't had them since

I use a Razer Tiamat 7.1. The sound is amazing even though my Xonar XD seems to have broken and have to use the onboard it is still sweet! A little pricey though
